2004 - Let’s open a bag of worms. The House of Representatives
recently passed the Marriage Protection Act, which in turn
makes the Defense of Marriage Act a piece of legislation
that CAN NOT BE CHALLENGED BY OUR COURTS. Did you catch
that? It’s extremely important. I’ll repeat
it, so we’re clear. The Marriage Protection Act, in
essence, says that the checks and balances that we enjoy
in this nation are moot in regard to issues of marriage
and that congress is the final unquestioned authority in
this matter. So sit back relax, enjoy, and let the Beefboy
do, what the Beefboy does best and break it right on down
for you.
The
Beefboy has to go back some distance to set you up for this
rant. I don’t have the space to seriously get into
the subject either the Defense of Marriage Act (DOMA) or
the Marriage Protection Act (MPA), but I’ll be brief
and point you here
if you want to know more. The Defense of Marriage Act was
passed in 1996 and basically was created to keep the laws
of one state from affecting the laws in another state in
respect to same sex marriage. The Marriage Protection Act,
which was passed in July by the House of Representatives
and has yet to go through the Senate, proposes to strip
the judicial branch of it’s right to challenge the
DOMA.
I’m
going a little further back to make my point, though. Waaay
back in 1803, Marbury vs. Madison set the precedent for
the Court to challenge laws passed by Congress. After that
landmark case Justice John Marshall said, it is the duty
of the judicial branch “to say what the law is.”
Ever since then, the Court (the Supreme Court and lower
Federal Courts) has engaged in Judicial Review which is
a vital component of America’s checks and balances
system.
Enough
history class - it’s time for Professor Beefboy to
lay the smackdown. I realize that gay marriage is a hotly
contested issue right now and that the idea of two men or
two women getting married makes conservatives start running
around like a 400lb woman with diarreah who’s about
100 yards away from the nearest potty, but that doesn’t
mean that you can subvert one of the most important aspects
of American government! Every micro-penis wielding conservative
nutsack in the House who signed that bill should be immediately
removed from office and sent back to grade school where
they belong!
Ever
heard of checks and balances guys? Checks and balances allow
the President the right to choose who becomes a judge, and
to veto silly legislation. It’s the thing that allows
Congress the right to question the President about his desire
to go to war, or approve his appointments to the judicial
branch. And, incidentally, it allows the Court to declare
Presidential acts and acts of Congress unconstitutional.
Get it? It’s one happy little fucking circle called
the Seperation of Powers that works like a charm and keeps
all branches of the government from getting too big for
their britches. Congress, you just outgrew your pantaloons.
We’ve
got an election in two months, we’re up to our eyeballs
in Iraqi feces and we still have Osama bin Laden breathing
down our necks; is there any possibility that Congress could
find something better to do with our time and money than
create legislation that will absolutely, unequivocally,
be challenged and defeated either in the Senate or in the
Courts? Why the fuck are GROWN MEN AND WOMEN, who I assume,
have taken and passed rudimentary civics classes, creating
fuck-off bullshit legislation that subverts the United States
Constitution and has served our country for well over 200
years?!!
The
Beefboy has a list of the nutsacks who believe that it is
more important to trash the Constitution than to allow even
a debate on the subject of gay marriage. Whether you think
gay marriage is good or bad (definitely a topic for another
article) we should all agree that side-stepping the Constitution
is without question, unacceptable. If you have a local congress
member who is on this list, please contact them and tell
them they need to quit their job immediately and find a
grade school where they can learn about a little document
we like to call the United States Constitution. Or better
yet, if any of those crapholes are running for re-election,
why don’t you make a point to give them some free
time to catch up on their studies… and vote their
ass out of office!
